Motor City Revs Up for Legal Showdown: Detroit Joins Michigan's Fight Against Coinbase's Prediction Markets

Detroit is about to throw its hat into the ring. Lawyers for the Motor City plan to file an amicus brief supporting Michigan in its lawsuit against Coinbase, which argues that federal regulators—not state gambling authorities—should oversee prediction markets. Because apparently, when you're Motor City, even your legal filings come with an engine rev.

In a Thursday filing in the US District Court for the Eastern District of Michigan, Judge Shalina Kumar gave Detroit the green light to weigh in. The city's legal team has until April 3 to submit their brief as the case grinds on. Nothing says "due process" like a deadline that falls right around the time you're filing your taxes and questioning your life choices.

Back in December, Coinbase sued Michigan (along with Connecticut and Illinois gaming regulators) more than a month before launching its prediction market services. Coinbase out here trying to dodge state gambling regs like they're dodging KYC requirements at a privacy coin mixer.

Platforms like Coinbase, Kalshi, and Polymarket are already facing multiple state-level legal battles. CFTC Chair Michael Selig has proposed new rules to bring the industry under federal oversight, but it's still anyone's guess how this federal-vs-state showdown will play out. It's basically regulatory whack-a-mole, except the moles are worth billions and everyone's holding a gavel.

"The more the CFTC can put a comprehensive regulatory regime around prediction markets, the more likely courts are to say this is a CFTC jurisdiction issue—not an end run around state sports gambling bans," said Stephen Piepgrass, a partner at Trout
